This Acceptable Use Policy ("AUP") is designed to protect the Clients of Ozzie Web Hosting and defines what is and isn't acceptable practices upon which
clients may use Ozzie Web Hosting's services, with a view to ensuring the integrity, security, reliability and privacy of the Ozzie Web Hosting network,
systems, products and services.
This AUP is incorporated by this reference into each Client's service agreement. Ozzie Web Hosting reserves the right to amend this AUP from time to
time as deemed necessary, and a Client's use of the Services after changes to the AUP are posted on Ozzie Web Hosting's web site (www.ozziewebhosting.com)
will constitute the Client's acceptance of any such amendments as will payment of each invoice.
This AUP in no way obligates Ozzie Web Hosting to (i) monitor, review, or police the data and content residing on its network or (ii) creates any obligation of
Ozzie Web Hosting to any party that is not a Client. Ozzie Web Hosting expressly disclaims any liability for the data and content residing on its network
and servers and for the actions of its Clients.
Prohibited Activities
The following activities are violations of this policy, and abuse of the Ozzie Web Hosting network and are prohibited:
1. Illegal Use, Threats and Harassment: Using the service to transmit any material that, intentionally or unintentionally:
a) violates any applicable local, state, national or international law, or any applicable rules or regulations;
b) threatens or encourages bodily harm or destruction of property; or
c) harasses another.
2. Fraudulent Activity: Using the service to make fraudulent offers to sell or buy products, items or services or to advise any type of financial scam such as
a "pyramid scheme", and chain letters.
3. Spam: Sending unsolicited commercials, messages or communications or unsolicited bulk email in any form or any activities that have the effect of
facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature.
4. Forgery or Impersonation: Adding, removing or modifying any identifying information (including any network header information) in an effort to deceive or
mislead or attempting to impersonate any person by using forged headers or other identifying information.
5. Unfair and inappropriate use of resources: Using unreasonably excessive resources on Ozzie Web Hosting's network, or otherwise degrading or interfering
with any other customer's use of a service or adversely affect the integrity, security or service levels of the Ozzie Web Hosting network.
6. General: Engaging in any activity that:
a) threatens the integrity or security of any network or computer system (including transmission of worms, viruses and other malicious code and accessing
any device or data without proper authorisation);
b) attempts to use the service in a manner so as to avoid incurring charges which would otherwise be applicable;
c) violates generally accepted standards of Internet or other network conduct and usage, including, but not limited to, denial of service attacks, web page
defacement, port and network scanning and unauthorised system penetrations.
Client may not publish or transmit via Ozzie Web Hosting's service any content that Ozzie Web Hosting has reason to believe:
(1) constitutes child pornography;
(2) constitutes pornography;
(3) is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
(4) is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
(5) is defamatory or violates a person's privacy;
(6) creates a risk to a person's safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation
by law enforcement;
(7) improperly exposes trade secrets or other confidential or proprietary information of another person;
(8) is intended to assist others in defeating technical copyright protections;
(9) clearly infringes on another person's trade or service mark, patent, or other property right;
(10) is otherwise malicious, fraudulent, or may result in retaliation against Ozzie Web Hosting by offended viewers.
Content "published or transmitted" via Ozzie Web Hosting's service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting
or transmission that relies on any Internet service provided by Ozzie Web Hosting.
Security:
Client must take reasonable security precautions to ensure the security of each Server. A Client is solely responsible for any intrusions into, or security breaches
of any of its Domains or Servers. Client must ensure to keep their passwords confidential and only disclose them to such employees who need to know them and
client will procure that those employees keep such passwords confidential. Ozzie Web Hosting reserves the right to disconnect without provision of service credit any Server or Account which disrupts Ozzie Web Hosting's servers, network or any hardware objects on the network as a result of a security compromise.
Copyright Protected Material/Intellectual Property Infringement Policy:
Client may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law, including the Digital
Millennium Copyright Act of 1998, unless:
(1) client has been expressly authorized by the owner of the copyright of the work to copy the work in that manner;
(2) client is otherwise permitted by established copyright law to copy the work in that manner.
Repeat copyright infringements will result in the client's service being terminated by Ozzie Web Hosting.
Bulk/Commercial E-mail
Client may not send unsolicited bulk messages over the Internet (i.e., "spamming") and must comply with all relevant legislation and regulations on bulk and
commercial e-mail, including the CAN-SPAM Act of 2003 and the Australian Anti Spam Legislation 2004.
Mass Mailings – Clients may not send mass unsolicited e-mail, which is email that is sent to recipients who have not opted in to mailings from the Client.
Mailing Lists – Clients are prohibited from operating mailing lists, listservs, or mailing services that do not target an audience that has voluntarily signed up
for e-mail information using an opt-in process or that has made their e-mail addresses available to the Client for distribution of information.
Clients who operate mailing lists and/or send mass mailings must maintain complete and accurate records of all consents and opt-ins, including the actual e-mail
and its headers, and provide such records to Ozzie Web Hosting upon request. If a Client cannot provide positive and verifiable proof of such consents and
opt-ins, Ozzie Web Hosting will consider the mass mailing and/or mailing list/s to be unsolicited.
Any Client-maintained mailing list must provide an unsubscribe option which allows any party on the list to remove themself automatically and permanently.
On shared servers no more than 500 emails may be sent from an account in an hour.
Block Removal:
If Ozzie Web Hosting's mail servers or IP address ranges are placed on black lists and other mail filtering software systems as a result of a Client's actions,
Ozzie Web Hosting shall charge the Client $120 up front and $120 per hour thereafter for any necessary remedial actions.
Newsgroups, Chat Forums, Other Networks:
Client must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which the client participates, such as IRC and
USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass
postings to multiple forums.
Ozzie Web Hosting, in its sole discretion may enforce this AUP with or without notice to a Client by any actions it deems necessary.
Ozzie Web Hosting reserves the right to recover any and all expenses, and apply any reasonable charges, in connection with a Client's violation of this AUP.
No service credits will be issued for any interruption in service resulting from violations of this AUP. Ozzie Web Hosting does not monitor or judge the content
of information transmitted using any service, but will investigate complaints of possible inappropriate use.
In the course of any investigation Ozzie Web Hosting will use all reasonable endeavours available to safeguard the privacy of all parties and will follow the
guidelines given in this policy and in Ozzie Web Hosting's privacy policy. However, Ozzie Web Hosting reserves the right at all times to investigate any actual,
suspected, or alleged violations of this AUP, with such investigation to include accessing of data and records on, or associated with, any Server.
